Nevada state law identifies driving under the influence (DUI) as operating a motor vehicle with a blood alcohol content of at least .08 percent, though technically if your blood alcohol content (BAC) is below .08 percent, you can still get arrested and charged with a DUI if a law enforcement officer feels that you failed a field sobriety testand are currently impaired. You can also get arrested for a DUI due to being under the influence of medications or a controlled substance. What you ultimately get charged with depends on a variety of factors, including your BAC, if anyone was injured as a result of you driving while impaired, and any past DUI convictions.

If a law enforcement officer notices you driving erratically and suspects that you may be impaired, they can pull you over and give you a field sobriety test. Based on your performance during the test, the officer may chose to administer a breathalyzer test, or a blood/urine test at a police station, all of which are used to determine your BAC.

However there are key areas where a law enforcement officer can act improperly, or fail to correctly follow their standard procedures. These can include violating your rights by pulling you over without just cause and incorrectly administering the field sobriety test.
