Field Sobriety Tests and DUI Arrests

Reno DUI Attorney

A field sobriety test (FST) consists of a series of behaviors that a law enforcement officer has a person go through, such as following the movement of a pen and walking a straight line, in order to help the officer determine if a person is operating a motor vehicle under the influence of alcohol or drugs. Based on the behavior of a person during the FST, an officer can arrest the person even if a subsequent breathalyzer test shows that they are under the legal limit for alcohol consumption.

However FSTs are an imperfect method of determining if someone is impaired and often mistakes are made by the officer when administering one. Even a perfectly administered test only correctly predicts when a person is driving under the influence 77 percent of the time, meaning that almost a fourth of people arrest for a DUI may not be driving while impaired.

Field Sobriety Tests and DUI Charges in Reno

If you have been arrested for a DUI, especially based on the results of a FST, a Reno DUI attorney can assist you. I have been practicing law for more than 25 years and have undergone the same training for administering a FST that law enforcement personnel in Nevada receive. This knowledge enables me to fully challenge how a FST was conducted and expose mistakes an officer made when administering it.

I’ll review all the available evidence, including any police video of the actual test, in order to identify areas that can be challenged in a court of law. I’m passionate about counseling people who have been arrested for a DUI and will work tirelessly on your behalf to help provide you with the best defense possible.

Contact a Reno DUI lawyer to discuss your situation and obtain experienced counsel for challenging a DUI arrest that was made primarily based on a field sobriety test.
